Legal background and legal basis for data processing

The background of data management is the provision of the Act CXII of 2011 on Informational Self-Determination and Freedom of Information (Privacy Act) and the Act C of 2000 on Accounting (Accounting Act). The legal basis for data processing is your consent in accordance with the Section 5, subsection 1 of the Privacy Act and – in case of revocation of its consent – the fulfilment of the legal obligation imposed on the Data Manager by the Accounting Act under the Section 6 subsection 5 of the Privacy Act.

Purpose of data management

Issue an invoice complying with the law and the fulfilment of the obligation to keep accounting records.Pursuant to Section 169 subsection 1 and 2 of the Accounting Act, business entities have to keep an accounting record directly and indirectly supporting the bookkeeping

Pursuant to Section169 subsection 2of the Accounting Act the invoices issued must be kept for 8 years from the date of issue of the invoice. We will inform you that, if you withdraw your consent to the issuance of your account, pursuant to Section 6, subsection 5 paragraph 2 of the Privacy Act, the Data Manger is entitled to retain your personal data for 8 years.

The Data Processor is involved in sending newsletters under a contract with the Data Manager.In doing so, the Data Processor handles the name and e-mail address concerned to the excent necessity for newsletters, and immediately deletes them at the request of the person concerned.

According to the contract with the Data Manager, the Data Processor participates in the bookkeeping of the accounting records. In doing so, the Data Processor shall use the name and address of the data subject to the extent required for accounting records, in accordance with Section 169 subsection 2 of the Accounting Act, and after that immediately deletes them

Data security measures

The Data Manager declares that he has taken appropriate security measures to protect personal information against unauthorized access, alteration, transmission, disclosure, deletion or destruction as well as unavailability due to accidental destruction and damage, furthermore any alteration in the technique used.

Rights that you have in data management

Within the duration of the data management, you are entitled to:

  • the right to information
  • the right to correct the data
  • the right to delete data
  • the right to block data
  • the right to protest

Within the period of data handling you may request information from the Data Manager regarding the handling of your personal data. In the shortest possible time, but no longer than 25 days after submission of the application, the Data Manager informs you on the data processed, the purpose, the legal basis and the duration of the data processing and – in case the data was transmitted – by whom and for what purpose the data was obtained.

Within the time of data handling you may request the Data Manager to correct your personal data. Your request will be processed by the Data Manager within 15 days.

You have the opportunity to request deletion of your personal data, which the Data Manager will complete within 15 days.The right of deletion does not apply if the Data Manager is obliged by the law to store data further, or in accordance with the Section 6, subsection 5 of the Privacy Act, the Data Manager is entitled to continue to handle personal data (such as billing).

You may request that the Data Manager locks out personal data if a permanent deletion of data would harm the legitimate interests of the data subject. Personal data locked like this can only be handled as long as there is a goal that excludes the deletion of personal data.

You may object to the handlingof your personal data, if

  • the processing or transmission of personal data is only necessary to fulfil the legal obligation of the Data Manager or to enforce the legitimate interest of the Data Manager, Data Provider or third party, except in the case of mandatory data handling and in the Section 6 subsection 5 of the Privacy Act
  • the use or transmission of personal data is made for direct business acquisition, polling or scientific research (without your consent).

The Data Manager will examine the protest within the shortest time, but within 15 days of the submission of the application, make a decision on its validity, and will inform you inwriting of his decision. If the Data Manager fails to complete his claim for rectification, blocking or cancellation, he will inform the person concerned in writing the factual and legal grounds for rejecting for rectification, blocking or cancellation within 25 days of receipr of the request.

Remedies

If you believe that the Data Manager has violated a legal provisionon data management or has failed to comply with any of your requests, you may initiate an investigation procedure for the Hungarian National Authority for Data Protection and Freedom of Information (Nemzeti Adatvédelmi és Információszabadság Hatóság) to terminate the presumed unlawful data handling (mailingaddress: 1530 Budapest, Pf.: 5., e-mail: ugyfelszolgalat@naih.hu).

We also inform you that, in the event of a violation of the law on data management, or if the Data Manager has failed to comply with any of your requests, you may turn to the court.
